  1. Jacob, an employee has committed Fraud upon his employer in 2023-2024 accounting year. Is Raheem eligible to get bonus for the 2022 – 2023 accounting year? Discuss.
  2. Whether a licensed porter working in a Railway Station is an employee under Employees Compensation Act, 1923? State reasons if yes and no.
  3. The management of Private college withheld the Certificates of the faculties, citing frivolous reasons and refused to return them to the faculties. Is the action valid and what are the remedies to the Faculties?
  4. An industrial establishment employed 150 additional workmen from January 01, 2023. The employer ignored certification of standing orders. Discuss the legal provisions.
  5. The workers of an establishment are paid with food grains in place of wages in cash. The woman worker is not receiving the food grain supplied by the employer. They claim for wages. Decide.
  6. A woman worker is terminated from services when she applied for maternity leave. She wants to challenge the termination. Advise her.
  7. The management provided transport to employees; an employee met with an accident while crossing the road. Is the employer liable to pay compensation? Decide.
  8. There is an agreement between the employer of an establishment and its workers that they should not have Provident Fund deduction by both the parties. Discuss the validity of the agreement.
  9. While working on a machine, a worker accidentally drops a valuable testing appliance which is broken. The employer deducts the value of the appliance from the wages of the worker. Is the deduction justified?
  10. P, an Apprentice Fitter, was injured while cleaning a dangerous part of a machine which had been manufactured abroad. The machine was unfenced while adjustments were made to it. Is the manager or occupier guilty of an offence?
  11. An employee goes to attend his work riding on a bicycle and is involved in an accident in the course of the journey and lost his right leg. Discuss whether employer is liable for compensation.
  12. Wives of 3 workmen employed in a textile factory work in place of their husbands for about half an hour every day after 7 p.m. while the later take meals brought by them. Discuss if there is a violation of any Provision of the Factories Act, 1948.
  13. A driver while driving a truck, sustains injuries in an accident. Because of the accident he loses the use of his right hand completely. The commissioner for Workmen’s Compensation decides that this is “Partial Disablement”. The driver desires to challenge this decision. Advise him.
  14. E.S.I. Corporation uses its funds in the construction of residential quarters for doctors and nurses. One of the E.S.I. contributors objects the use of the said amount as it is not for ESI purposes. Is it valid? Decide.
  15. A worker employed in a Factory died by accident while in service before completion of two years of his employment. His widow claimed gratuity from the employer. The employer refused to pay the same on the ground that the employee has died before completion of five years of continuous service. Decide whether gratuity is payable.
  16. The employer has refused to pay minimum wage on the ground that he is not earning any profits. Is this contention of the employer valid under Minimum Wages Act. Decide.
